A company Top Level Domain (TLD), a such like (stargames.fi), is often one of the companies´most important marketing and sales tools. For example, in an e-commerce business, the entire turnover of a business can be generated through a website. In modern business, it does not matter, what kind of TLD a company or its competitors can register. This is a question of the relationship between TM law and Business Name Law in the domain.

European Union Trademark Regulation (EUTMR) Article 4 defines the concept of TM as a capability to distinguish the good and services of the one undertaking from those of other undertakings. An extended TM protection under Article 5 (2) of the TM Directive requires that the TLD be perceived by the target public as having a link with the TM. Extended protection can be obtained even when the site created is marketing non-similar goods or services for which the TM is protected.

Now the use of the TLD must begin in such a way that it does not harm or abuse the reputation or distinctiveness of the TM. The components of the authentic IPR reference framework connecting the company's name, elements such as the international trademark registered in WIPO with number 1608349 and the use of TLD.com.tr or ccTLD.tr must be agreed with the management authorized by the internationally first registered Stargames Oy.
